The following release from the Administrative Office of the United States Courts announces the decision of the Judicial Conference of the United States to amend the Electronic Public Access Fee Schedule, effective April 1, 2013. Additional information is available at http://www.pacer.gov/ .

PACER Fee Schedule Revision To Take Effect April 1

Pursuant to sections 1913, 1914, 1926, 1930, and 1932 of Title 28, United States Code, the Judicial Conference, at its March 12, 2013 session, amended the Electronic Public Access Fee Schedule for the appellate, district, and bankruptcy courts, the United States Court of Federal Claims, and the Judicial Panel on Multi-district Litigation. The fee schedule was revised to (a) make format and style changes; (b) clarify the principles underlying the exemption policy; (c) clarify that attorneys of record and parties in a case(including pro se litigants) may receive one free electronic copy of all documents filed electronically via the notice of electronic filing (or notice of docket activity); and (d) clarify that non-case specific reports are not subject to the 30-page fee cap.

      In General Order No. 15-2013, the Bankruptcy Court for the Northern District of Georgia adopted the Court Registry Investment System (“CRIS”) administered by the Administrative Office of the United States Courts under 28 U.S.C. § 2045, as the authorized investment mechanism. Parties not wishing to transfer certain existing registry deposits into the CRIS may seek leave to transfer them to the litigants or their designees on proper motion and approval of the judge assigned to the specific case.

Important information about GANB CM/ECF Release 5.0 and upcoming GANB CM/ECF Unavailability:

 

1) Version 5.0 is now loaded in the GANB Train database.

2) Here is an overview of the enhancements included in release 5.0.

Release CM/ECF 5.0 will be installed in the GANB Live database Saturday, January 19, 2013 through Monday, January 21, 2013 (MLK Day). CM/ECF will be unavailable to all users during the installation process. An email will be sent when the system is fully operational.

The enhancements for this release were detailed at the November 2, 2012 meeting with the Clerk.

Regarding General Order 14-2012

 

On November 28, 2012, the Court entered General Order No. 14-2012 which adopts Interim Bankruptcy Rule 1007-I when it becomes effective on December 1, 2012. Current Interim Rule 1007-I incorporates provisions of Federal Rule of Bankruptcy Procedure 1007(c) which will be amended December 1, 2012, specifically to eliminate the existing time limit for filing the list of creditors in an involuntary bankruptcy case. This deletion will conform the deadlines in Rule 1007(c) and Rule 1007(a)(2), the latter having been amended December 1, 2010.

***IMPORTANT ANNOUNCEMENT REGARDING CENTRALIZED PROCESSING OF RETURNED MAIL***

On October 15, the Judiciary's Bankruptcy Noticing Center (BNC) will implement changes to procedures related to notices of returned mail. These changes DO NOT affect notices and orders served by the Court only those served by the BNC.

Current procedure for BNC mailings

In the Northern District of Georgia, the address of debtors' counsel is used as the return address for virtually all papers processed by the BNC.

This returned mail is processed two ways:

(1) individual pieces are forwarded to the attorney via the USPS by the BNC with no involvement of court personnel

(2) items that were originally "multi stuffed" (multiple pieces of mail intended for the same recipient ) are returned to the court which then issues individual notices to the appropriate attorneys

Effective October 15, 2012

"Multi-stuffed" parcels will no longer be forwarded to the court. Rather, debtors' attorneys will receive email notification about these items instead of receiving a notice from the court. The BNC will have two business days from receipt to process the returned mail and generate an email notification with a copy of the returned item as a pdf attachment. In those instances where an email address is unavailable or for pro se cases, the returned mail notice will be sent via the USPS to the attorney or pro se debtor. Please note that CM/ECF attorneys with no email address of record will be required to add an email address to the account information.

Here is a sample of the returned mail notice sent via email.

The Northern District of GA will allow use of this form to update address information for a party already scheduled. Pay special attention to the instruction that this notice may not be used to add a new creditor not previously listed in the schedules.

In summary, beginning mid October, debtors' attorneys will begin receiving returned mail in two ways: regular USPS service will continue for individual pieces of returned mail. Email notices from the BNC will replace the notices previously issued by the Court with respect to returned mail.

This revised procedure will save well over 1 million dollars a year in postage as well as the time previously needed to manually process these items.

The fee for filing a Chapter 11 bankruptcy case will increase for cases filed on or after November 21, 2012. The fee increase was included in the Temporary Bankruptcy Judgeships Extension Act of 2012 (Pub. L. No. 112-121), which was signed into law by the President on May 25, 2012.

A provision in the law increases the statutory filing fee for all new Chapter 11 cases to $1,167. The total fee for filing a Chapter 11 case will increase to $1,213 (statutory fee of $1,167 under 28 U.S.C. § 1930(a)(3) plus the administrative fee of $46 under Item 8 of the Bankruptcy Court Miscellaneous Fee Schedule). The fee table included on the court's website will be updated on November 21, 2012.

Friday, September 28th, 2012, marks a significant milestone for the Bankruptcy Court in the Northern District of Georgia. Ten employees will retire, taking with them many years of experience and knowledge that will be hard to replace. Two of these - Sandy Buckley and Cheryl Goss - are well known to many of you.

Sandy has been present in Judge Margaret Murphy's courtroom for the last 25 years. Cheryl Goss has worked in courtroom services for 30 years, the last ten being with Judge Paul Bonapfel. Both covered other duties with the court before assuming their present positions. We wish them only the best as they begin new adventures.

Judge Murphy

Christina Lee, formerly a case administrator in the Atlanta office, will assume the courtroom duties for Judge Murphy.

Connie Mason will begin working in the Atlanta office, covering Judge Bonapfel's full caseload. Going forward, Connie will handle matters for Judge Bonapfel only , both in Atlanta and Rome.

NOTICE to GANB CM/ECF Participants regarding upcoming change in location of Chapter 7 341(a) Meetings in Newnan Division

Effective October 1, 2012, section 341(a) meetings for Chapter 7 cases only in the Newnan Division will be conducted at the Country Inn & Suites, located at 1125 Newnan Crossing Blvd. E, Newnan, GA 30265. It is anticipated that the first Chapter 7 meeting date at this location will be on October 4. This change does not affect Chapter 13 meetings of creditors.

The 341 room is located on the bottom level. You may access the room directly from the parking lot (by stairs) or from inside the building (by stairs or elevator). The meeting room is larger than the room at Comfort Inn. There is an ante room and an adjoining conference room.

From time to time, the U. S. Trustee's Office may schedule Rule 2004 examinations in the conference room the mornings on which Chapter 7 meetings of creditors are scheduled in the afternoon.

Redaction Policy Regarding Personal Identifiers in Documents Other Than Transcripts

A policy regarding the filing of redacted documents has been added to the Court's Website at the Clerk's Office page under Redaction Policy (Non-Transcripts). This policy memorializes a long-standing Court practice relating to the replacement of a document which contains personal identifiers (i.e. Social Security or taxpayer identification number, birth date, names of minor children, and financial account information) with one from which the personal identifiers have been redacted.

PUBLIC NOTICE

 

As you may know, the Honorable Joyce Bihary is retiring today, May 31, 2012, after 25 years on the bench.

A new judge will fill this vacated position in the very near future. At the time of the appointment, Judge Bihary's existing caseload will be transferred to the new judge immediately. In the interim period, Judge Bihary's caseload, as well as newly assigned cases, will receive a temporary judge code designation of "A998." This code will appear on notices, orders, forms and other documents issued by the Court. When the new judge is in place, the A998 code will be replaced with that judge's name and initials. In the meantime, our website will include a chambers page for "Judge A998" with available hearing dates for these cases.

Accordingly, please adjust your computer systems, programs, forms, etc... so that Judge Bihary's name, initials, signature blocks and the like are no longer included on pleadings and orders submitted to this Court.

Regarding Revised Fee Table

 

This revised Fee Table is effective April 1, 2012. The Fee Table is revised to reflect an increase in PACER access fees from eight cents a page to ten cents a page, beginning April 1, 2012.  The information on the Fee Table has also been reorganized and certain fees have been clarified, such as the Appeal and the Notice of Appeal fees.

Pay.gov, which is the application that allows payment of fees in the CM/ECF system, will be upgraded on March 3, 2012. As a result, the ability of CM/ECF participants to pay filing fees will be interrupted on Saturday, March 3, 2012 between 6:00PM and 12:00AM due to the deployment of Pay.gov 5.1. We realize that this date is the Saturday preceding foreclosure, however, this upgrade is being directed by the Federal Reserve Bank in Cleveland which is responsible for the Pay.gov utility. We apologize for any inconvenience.

The United States Bankruptcy Court for the Northern District of Georgia has published Mediation Procedures which formalize the current procedures to follow in the District. The guidelines are available on the Court's website (www.ganb.uscourts.gov) under the "Forms" tab or via this hyperlink. The procedures include a sample "Order Authorizing and Directing Mediation." Please note that under no circumstances should the parties contact the judge the parties desire to serve as mediator unless and until the assigned judge has approved the mediation and determined the selected judge's willingness and availability to serve as the mediator.

On November 24, 2010, the Court entered General Order No. 12-2010 adopting amended Interim Rule 1007-I. Amended Interim Bankruptcy Rule 1007-I is scheduled to take effect on December 1, 2010. As amended, Interim Bankruptcy Rule 1007-I: 1) shortens the time for a debtor to file a list of creditors in an involuntary case from 14 days to 7 days after the entry of an order for relief, and 2) extends the time for an individual Chapter 7 debtor to file a statement of completion of a course on personal financial management to 60 days from 45 days after the first date set for the meeting of the creditors.

Effective October 25, 2010 all Atlanta Division Chapter 13 cases assigned to Judge W. Homer Drake, Jr. and Judge Robert E. Brizendine will be reassigned to Judge James R. Sacca. All previously noticed hearings scheduled for Courtroom 1202 and previously noticed deadlines remain the same. Hearings scheduled going forward will be held in Courtroom 1404.

Adam M. Goodman will remain the Chapter 13 Trustee assigned to these cases.

Press 18 to access the Georgia Northern Bankruptcy Court

MCVCIS provides the public automated case information.  This voice case information system can be accessed from any touch tone telephone and is available 24 hours a day, 365 days a year, except for system maintenance. A computer and modem are NOT necessary to access the MCVCIS System.

New cases and adversary proceedings will typically appear in MCVCIS one to two days after filing.

MCVCIS is provided free of charge.
To access this information system and obtain information concerning Northern District of Georgia bankruptcy cases and adversary proceedings, please follow the instructions set forth below.

1.

Using a touch-tone telephone dial 1-866-222-8029. A computer synthesized voice will answer the call and ask you to select a language. Press 1 for English or 2 for Spanish.

2.

You will then be asked to select a bankruptcy court district. For information concerning Northern District of Georgia bankruptcy cases and adversary proceedings, press 18.

3.

The system allows 5 searches per call. For instructions on using the system, press 1. You may search for cases by case number, by a debtor’s name, or by a debtor’s social security or tax ID number.

 

A.

To search by case number, press 2.

 

 

1.

Enter the four digit year in which the case was filed by pressing the keys on your telephone corresponding with the numbers in the year.

 

 

2.

Enter the last five digits of the case number.

 

B.

To search by a name, press 3.

Press the keys on your telephone corresponding to the letters in the name. Use the 1 key to enter the letters Q and Z; do not attempt to type in spaces between names, or characters (such as apostrophes and hyphens) that are not letters.

 

 

1.

For individuals, enter the last name, first name, and middle initial, if possible, followed by the # sign.

 

 

2.

To enter the name of a company, type the company name, omitting suffixes such as Inc. and Corp., followed by the # sign.

 

C.

To search by a social security or tax ID number, press 4.

Type the debtor’s full social security or tax ID number, omitting any hyphens or spaces.

4.

MCVCIS will search the data base for the case number, name, social security number, or tax ID number entered in the System.

 

A.

If the case number, name, social security number, or tax ID number entered is not found on the database, MCVCIS will respond “No matching cases were found.”

B.

If one matching case is found, MCVCIS will provide the information available for that case.

 

C.

If multiple cases involving the same person are found, MCVCIS will provide the information available for the most recently filed case.

If more than one matching person is found, MCVCIS will respond “Multiple matching cases were found. Please search by social security number or tax ID number.”

5.

After providing information on the first search, MCVCIS will return you to the Main Menu. To perform another search, repeat step 3 above.

6.

After 5 searches, you will be disconnected from the System. For information concerning additional cases, please redial MCVCIS.

 

General Information Available

 

  • Case number;
  • Name(s) of debtor(s), or principal party(ies);
  • Date the case was filed, whether a voluntary or involuntary petition was filed,
    and the chapter under which the petition was filed;
  • Name and phone number of the debtor’s attorney;
  • Trustee's name;
  • Name of the Judge to which the cases is assigned;
  • Discharge and closing dates;
  • Whether there are assets in the case;
  • 341(a) meeting date, time, and location;
  • Case status; and
  • Case disposition.

NOTICE

 

Beginning Monday, July 12, 2010, there will be a change to the Bankruptcy Noticing Center's (the "BNC") mailing procedure involving invalid addresses.

The BNC will no longer mail a notice to an invalid address, as identified by the US Postal Service. Instead, the BNC will issue a bypass notification which will:

(1) include a copy of the notice that the BNC did not mail to the undeliverable address;
(2) identify the creditor and the undeliverable address;
(3) instruct the debtor to immediately mail the undelivered notice to the creditor;
(4) inform the debtor that the BNC will not mail future notices to the undeliverable address; and
(5) include space on the notification for the debtor to insert a corrected address.

The attached notice provides further information about the change in procedure.

This Notice concerns important amendments to certain Federal Rules of Bankruptcy Procedure (“Bankruptcy Rules”), Local Bankruptcy Rules, Bankruptcy related statutes and Bankruptcy Forms that will take effect on December 1, 2009. New GANB CM/ECF Docket Events - The following two new docket events have been added. They are to be used when docketing Form B22A (Statement of Current Monthly Income and Means Test Calculation (Chapter 7)) on behalf of individuals who claim a temporary exclusion from the means test requirements as permitted under the National Guard and Reservists Debt Relief Act of
2008:

1. Statement of Debtor's Temporary Exclusion from Means Test - to be used when the debtor is no longer on active duty; and,

2. Release from Active Duty - to be used when debtor is on active duty when the case is filed but is released from active duty later in the case.

The Clerk's Office was asked to implement a mechanism that would alert electronic filers attempting to file a new petition that a case was filed within the previous 7 days that matches the SSN of the case being uploaded.

We have been successful, and you will now see an alert that tells you a case already exists. You will have the option to continue if you wish. We are hopeful this new tool will be beneficial to you. Please let us know if you experience any problems.

On Thursday, September 27, 2007, the Administrative Office of the United States Courts announced that the Electronic Public Access Fee Schedule has been amended to include court-appointed pro bono attorneys among that category of persons that a court may exempt from PACER fees upon the proper showing. This amendment is effective September 18, 2007. A copy of the amended fee schedule is available by clicking HERE .
