Overview

 

A Motion to Redact Personal Identifiers (FEE) is filed by a debtor, debtor’s counsel or any other party in interest, to request that the court restrict access to a previously filed document containing personal identifiers. The motion should identify the information that was improperly included in the original filing with the court. The filing party will also need to file a complete redacted document as a SEPARATE ATTACHMENT to the motion when it is filed.

 

IF the motion seeks to redact any information outside of Rule 9037(a), the filing party should immediately prepare an e-order for submission to chambers (see Single Order Upload) after filing the motion.

 

IF the motion seeks to redact any of the following information outlined in Rule 9037(a), the filing party should NOT upload an e-order:

 

·      Social Security number

·      Taxpayer identification number

·      Financial account number

·      Full dates of birth or full names of minor children

 

The motion may be filed in a closed case so long as it is to redact one of the four personal identifiers listed in FRBP 9037(a). A motion to reopen would not be required in this instance.

o     $25.00 each time a motion is filed, not for each document needing redaction

·      Redacted document(s)

o     Filed as a SEPARATE ATTACHMENT to motion

o     Must be a complete and full copy

·      Certificate of Service

·      Notice of hearing

 

NOTE: A Proposed Order is only required when the motion seeks to redact information outside of FRBP 9037(a).

 

NOTE: If this is an amended motion to redact, no fee will be charged but the filer must be amending a previously filed motion to redact in which the fee has been paid. In addition, the motion must be requesting redaction of the same document identified in the original motion.

·      Ensure Filing Requirements are met

·      Select Bankruptcy

·      Select Motions/Applications

·      Enter case number (xx-xxxxx)

·      Click Next

·      Select the party filer

·      Click Next

o     IF the party is not listed

§      Use Add/Create New Party

§      Click Next

·      If you see the message: IMPORTANT: The following attorney/party association(s) will be created in this case. De-selecting a party association will result in the filing attorney NOT receiving Notices of Electronic Filing for that party. If this is a joint filing, review the list carefully to ensure that only parties represented by the filing attorneys are selected.

o     Remove the check mark from any party not represented by the filing attorney

o     Click Next

·      Select Redact Personal Identifiers (FEE), Motion to

·      Click Next

·      Click Next

·      You will see the message: You MUST submit the complete redacted document as a SEPARATE attachment to this Motion by selecting [Attachment to Document: Yes] on the next screen!

·      Click Next

·      Browse to select the document to be filed (PDF)

·      Answer the question: Is this an amended Motion to Redact?

·      Click Next

·      Fee of $__ will appear on screen, if applicable (see Fee Table for amount)

·      You will see the message: Do NOT upload a proposed order IF the motion seeks only to redact personal identifiers listed in FRBP 9037(a).

·      Refer to existing event(s), if applicable

o     IF referring to an existing event

§      Insert hearing information, if applicable

     Click the clock icon to select Hearing Time

     Click the calendar icon to select Hearing Date

     Click the drop-down menu to select Location

     Click Next

§      Select the category to which your event relates

§      Click Next

§      Select the appropriate event(s) to which your event relates

§      Click Next

o     IF not referring to an existing event

§      Insert hearing information, if applicable

     Click the clock icon to select Hearing Time

     Click the calendar icon to select Hearing Date

     Click the drop-down menu to select Location

     Click Next

·      Modify the docket text by using the drop-down and free text boxes to enter additional information, if necessary

·      Click Next

·      Verify docket text

·      Click Next

·      A Summary of current charges box will appear (if not filing an amended motion to reopen)

o     IF paying now

§      Click Pay Now

§      Make the applicable selection under Check Fees to Pay

§      Click Next

§      Verify the Internet Payments Due

§      Click Pay Now

§      Submit payment using the Online Payment screen

o     IF not paying now

§      Click Continue Filing
