A Motion to Compel is generally filed by the debtor or debtor’s counsel but may also be filed by any other interested party to request the court to order either the opposing party or a third party to take some action.

 

NOTE: Do not use this event to request the Court compel abandonment, debtor to perform Section 521 duties, discovery, or payment of post-petition expenses. Use events Motion to Compel Abandonment of Property, Motion to Compel Debtor to Perform Section 521 Duties, Motion to Compel Discovery, or Motion to Compel Payment of Postpetition Expense.

·      Motion should be in basic captioned format

·      Certificate of Service

·      Notice of hearing

·      Ensure Filing Requirements are met

·      Select Bankruptcy

·      Select Motions/Applications

·      Enter case number (xx-xxxxx)

·      Click Next

·      Select the party filer

·      Click Next

o     IF the party is not listed
