PUBLIC NOTICE

U.S. Bankruptcy Court, Northern District of Georgia

Important GANB Docketing Event Change -

Effective Tuesday, April 1, 2014

Currently there are two CM/ECF events used to add/amend creditors - (1) Amendment to Schedules D, E and/or F (FEE) & (2) Amended List of Creditors (FEE).

CM/ECF administrative procedures for the event - Amendment to D, E and/or F (FEE) - include a two step process with the following requirements:

- an amendment cover sheet detailing the changes included on the amended schedules
- if creditors are being added, a supplemental list of creditors containing ONLY the names and addresses of those creditors added by the amendment

AND for the second step of the process

- the supplemental list of creditors should be saved separately in a text(.txt) format so that creditors added can be uploaded electronically (access the Creditor Maintenance menu to upload).

Beginning Tuesday, April 1, 2014, users will be able to docket amendments to D, E, and/or F as well as upload the amended creditor information in one unified process. In other words, the second step of saving the text file and accessing the Creditor Upload feature through the Creditor Maintenance menu will no longer be necessary.

In addition, many prompts have been added to remind filers of the importance of including the cover sheet, the supplemental list of creditors containing the names / addresses only of the added creditors, and of adding the creditor information to the electronic file.

There will still be instances where one may elect to follow the two step process. If, for example, a large number of creditors are being added, using the text file may be more efficient.

The second event - Amended List of Creditors (FEE) - is still available and will have the prompts allowing the user options for the manner in which creditor names/addresses are added to the record.

When using either event - Amendment to Schedules D,E and/or F (FEE) or Amended List of Creditors (FEE) - the user should complete the process in full. Failure to do so will prevent parties from being properly served with future notices from the Court.

You may access these revised events in the Test Database and practice docketing before April 1, 2014. This change will simplify the docketing process and significantly reduce the number of deficiency notices issued.

Thank You

PUBLIC NOTICE

United States Bankruptcy Court, Northern District of Georgia

Effective December 1, 2013, Federal Rule of Bankruptcy Procedure 1007(b)(7) was amended to permit an approved debtor education provider to notify the court directly that the debtor has completed a post-petition instructional course concerning personal financial management.*   This rule change pertains to debtor education certificates only, not to credit counseling certificates.

Approved personal financial management course providers may now electronically file the Certificate of Debtor Educationunder Rule 1007(b)(7), using the electronic financial management course certificate filing program (eFinCert) rather than registering as a limited user in the court’s CM/ECF case management system.

Pursuant to Federal Rule of Bankruptcy Procedure 1007(c), the debtor must file a statement that he/she completed the personal financial management course within 60 days after the first date set for the meeting of creditors under § 341 of the Code in a chapter 7 case, and in a chapter 11 or 13 case no later than the date when the last payment was made by the debtor as required by the plan or the filing of a motion for discharge under § 1141(d)(5)(B) or § 1328(b) of the Code.  Failure by the provider to timely file the certificate in accordance with Fed. R. Bankr. P. 1007(c), will result in the debtor’s case being closed without a discharge.  See Fed. R. Bankr. P. 4004(c)(1)(H).

Use this link to file the course certificate File Personal Financial Management Course Certificate (eFinCert) Going forward, access this link by clicking on the Electronic Case Filing (ECF) tab on the Court's website.

NOTICE regarding new Order Regarding The List of Creditors

On Friday, November 1, the Court will begin issuing an Order Regarding The List of Creditors in cases where missing creditor information prevents the Clerk's Office from serving in a timely manner to affected creditors the Notice of Commencement of Case (341 Notice).

The Order Regarding The List of Creditors will address the failure to provide a list of creditors in both paper and electronic cases. The order will also address the failure to properly upload these creditors in an electronically filed case at the time voluntary petition is filed. The order will provide a seven (7) day deadline to cure any deficiency noted.

In an electronically filed case, the list of creditors should be docketed in pdf format to comply with Rule 1007(a)(1) and provide a means to verify the accuracy of the electronic record. Additionally, creditor information should be uploaded electronically. Both of these actions are critical and necessary.

Please note, in order to cure the deficiency in cases where the creditor information is not uploaded properly, the attorney will be required to docket a certificate of service showing that all creditors have been served with the Notice of Commencement of Case.

Thank you for your attention to these important process changes.

Update on Operations During the Government Shutdown

On October 1, 2013 the government officially commenced a partial shutdown due to the lack of an appropriations bill or continuing resolution that would authorize and provide funding for an interim period. Because the Judiciary receives non-appropriated funds, it has and will continue operations through October 17, 2013 without a final budget for fiscal year 2014 or, in the alternative, a continuing resolution.

Until further notice, the United States Bankruptcy Court for the Northern District of Georgia will continue to operate under its normal schedule in all divisions (Atlanta, Newnan, Rome and Gainesville). The Court's case management system, CM/ECF, as well as PACER, will remain available, even in the event of a Judiciary shutdown.

All hearings and §341 meetings of creditors will be held, as noticed.

We will provide additional information as it becomes available.

***IMPORTANT ANNOUNCEMENT REGARDING CENTRALIZED PROCESSING OF RETURNED MAIL***

On October 15, the Judiciary's Bankruptcy Noticing Center (BNC) will implement changes to procedures related to notices of returned mail. These changes DO NOT affect notices and orders served by the Court only those served by the BNC.

Current procedure for BNC mailings

In the Northern District of Georgia, the address of debtors' counsel is used as the return address for virtually all papers processed by the BNC.

This returned mail is processed two ways:

(1) individual pieces are forwarded to the attorney via the USPS by the BNC with no involvement of court personnel

(2) items that were originally "multi stuffed" (multiple pieces of mail intended for the same recipient ) are returned to the court which then issues individual notices to the appropriate attorneys

Effective October 15, 2012

"Multi-stuffed" parcels will no longer be forwarded to the court. Rather, debtors' attorneys will receive email notification about these items instead of receiving a notice from the court. The BNC will have two business days from receipt to process the returned mail and generate an email notification with a copy of the returned item as a pdf attachment. In those instances where an email address is unavailable or for pro se cases, the returned mail notice will be sent via the USPS to the attorney or pro se debtor. Please note that CM/ECF attorneys with no email address of record will be required to add an email address to the account information.

Here is a sample of the returned mail notice sent via email.

The Northern District of GA will allow use of this form to update address information for a party already scheduled. Pay special attention to the instruction that this notice may not be used to add a new creditor not previously listed in the schedules.

In summary, beginning mid October, debtors' attorneys will begin receiving returned mail in two ways: regular USPS service will continue for individual pieces of returned mail. Email notices from the BNC will replace the notices previously issued by the Court with respect to returned mail.

This revised procedure will save well over 1 million dollars a year in postage as well as the time previously needed to manually process these items.

Please contact the Clerk's Office for additional information or assistance.
