PUBLIC NOTICE

Notice to all GANB CM/ECF Participants of upcoming GANB ECF COOP test with interruptions to service, scheduled for Tues., 8/14/12

On Tuesday, August 14, 2012, there will be intermittent interruptions in the availability of Georgia Northern Bankruptcy's CM/ECF between the hours of 9:45AM to 2:00PM (Eastern Daylight Time) to allow the Court to participate in COOP (Continuity of Operations Plan) exercises. A message will be sent when the testing is complete. We apologize for any inconvenience and thank you for your cooperation.

Want more details ? In order to be better prepared to handle an emergency situation, the Court is conducting a COOP exercise (Continuity of Operations Plan) which contemplates the primary CM/ECF server being totally out of commission. We will switch to our off-site replication server to ensure that all essential CM/ECF functions can be performed on that server as designed (known as the "fail-over" process). This procedure should be transparent to external users except for a small window of time when the internet addresses (IP's) will be changed between the production servers and the Replication servers. Changing IP addresses over the Internet is an extremely involved process but we anticipate that this delay will not be more than thirty minutes. During this delay the CM/ECF server will be unavailable for use.

At 12:00 noon we will begin the Fail-Back process, and it is estimated to run thru 1:00PM. We estimate that this process will create at least one hour of downtime to ECF. It is our plan to return ECF service to you by 2:00 p.m., and, as mentioned above, an email message will be sent when GANB ECF returns to full operational status.

07.17.2012

Announcement of Proposed Official Forms for Plan and Disclosure Statement
in Small Business Chapter 11 Cases

A provision of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 required the Judicial Conference of the United States to design an official form for the Chapter 11 plan of reorganization and disclosure statement for small business debtors as defined in 11 U.S.C. § 101(51D). Pub.L. 109-8, Title IV § 433, 119 Stat. 110 (2005). The Judicial Conference has approved these forms, and the Small Business Chapter 11 Plan/Official Form 25A and Disclosure Statement/Official Form 25B will become effective on December 1, 2008, if approved by the Supreme Court and Congress does not act to the contrary. As the Committee Notes accompanying these forms make clear, both Official Forms are “intended to provide an illustrative format rather than a prescription for the language or content” of either. Although these Official Forms are not yet effective and will not be mandatory, they may be useful in providing guidance as to the information and disclosures required in such cases.

Announcement for Form Stipulations

To facilitate the preparation and presentation of consent orders to resolve motions of lenders for relief from the automatic stay to foreclose on real estate in Chapter 13 cases, the Bankruptcy Judges, other than Judge Murphy, have approved the use of a form stipulation on which the parties check boxes to select applicable provisions of their agreement and fill in blanks for variable items such as the property description, the amount of arrearage, and payment terms. The parties then attach the completed stipulation form to a proposed consent order that incorporates it as the order of the Court and present it to the Bankruptcy Judge for consideration and entry, if appropriate.

The consent order, with the stipulation attached, may be submitted as an E-Order or in paper form. If the submission is not made at the hearing on the motion, the Judges encourage the submission to be made by E-Order. Use of the form is not mandatory.
The forms are available in downloadable or printable form on the “Local Forms” page of the Court’s website.
Use of the form is not permitted in cases assigned to Judge Murphy; a different version of the form stipulation and order approved by Judge Murphy for use in her cases will be posted on Judge Murphy’s section of the Court’s website.
